​Recovery of INSS Paid Above the Ceiling for Doctors, Teachers and Self-Employed Workers

Many professionals, including doctors, teachers and self-employed individuals in the private sector, with more than one employment relationship, may be contributing to the INSS beyond the established limit, resulting in undue payments. Normative instruction no. 971, of 2009 and ordinance no. 2, of 2024 establish a maximum limit for contributions to the INSS - R$ 7,786.02. Any amount paid beyond this limit may be refunded.

​Who is eligible?

Doctors, teachers and self-employed workers: Professionals who have multiple sources of income or contributions that, when added together, exceed the social security ceiling established by law.
Right to Refund: If you have paid INSS contributions above the ceiling in the last 5 (five) years, you have the right to request a refund of these amounts. The law allows for the review and recovery of these amounts paid unduly.


Legal Basis:

According to tax and social security legislation, in particular normative instruction no. 971/09 (art. 87, § 2, item I, item "b") and ordinance no. 2, of 2024, of the Federal Revenue Service, contributions to INSS must comply with the social security ceiling of R$ 7,786.02. Any excess paid in error must be recovered upon request.
